Commercial Rent Arrears Recovery

Bond Street Consultants Commercial Rent Arrears Recovey (CRAR) service is fully compliant with Section 72 of the Taking Control of Goods Act 2013 as required by the Tribunals, Courts and Enforcement Act 2007.

 

Our Certificated Enforcement Agents (CEA) are available nationally.

 

CRAR is only to be used for the recovery of Commercial Rent were there is no residentail element to the lease or property. ONLY rent can be recovered, this does not include any form of service charge or insurance premium. Rent must be in at least 7 days arrears.

 

The introduction of CRAR in 2014 saw a fundamental change in the process of recovery. A Notice of Enforcement has to be sent to a tenant giving 7 clear days (plus postage days and not including Sundays) notice of an enforcement visit

giving the tenant an opportunity to pay. This notice has a fee fo £75.00 plus vat (£90.00) payable by the tenant. 

 

Only the goods of a tenant on the demised property may be seized. If the tenant fails to pay in full or fails to enter into a

Controlled Goods Agreement, the goods have to be sold at public auction with 7 days notice given before the sale commences.
